Default rear shock failure

i have an 08 santafe that i bought used with 14k miles...its now at 22k and while changing the oil i noticed the passenger side rear shock was leaking fluid...i understand wear and tear...but a shock going bad this early is crazy. I'm wondering if this falls under warranty due to so little miles on the vehicle.

Shocks are a wear item, not coved under the warranty after the first 12 months.
